Copyright law in the United States
Introduction
The United States has a copyright law that protects original works of authorship. This includes books, movies, music and other types of work created by an author or producer. It also protects the artistic expression found in graphic art and computer software.
What is copyright?
Copyright is a form of intellectual property. It protects original works of authorship, including books and other written material, paintings and sculptures, films and videos and audio recordings. Copyrights are automatic (that is, they do not require registration) and last for the life of the author plus 70 years after his or her death.
The exclusive rights granted by law to creators under copyright include:
-
Reproduction in any manner or medium; distribution to the public by sale or other transfer of ownership; performance; broadcast transmission over radio or television networks; public performance before an audience in general view apart from any place where admission charges may be made with respect to such presentation (with some exceptions). These rights may be extended beyond those given above through contractual arrangements between author/owner/copyright owner(s)
What does copyright protect?
-
Copyright protects the expression of ideas, not the ideas themselves. A work can be protected even if it’s an idea that wasn’t copyrighted. For example, if you write a book about how to make a better mousetrap and publish it in bookstores or online, then your mousetrap may be considered “copyrightable” under United States copyright law. This means that anyone who buys your book can use your invention without paying you anything (although they would still have to pay tax on any profits). But it doesn’t mean that any idea contained within those pages is protected by copyright! The same goes for websites where users post their own content; those posts are not legally protected just because someone else put them there first!
How is a copyright different from a patent or a trademark?
In the U.S., patent and trademark protect the form of a product or service. Copyrights protect the form of a work (rather than its utilitarian aspects).
A patent protects an invention by giving it a limited time period during which it can be used by others in order to profit from its sale or use. It also prevents others from making similar products during this time period; however, patents are not required to be registered before they expire unless they are being held by someone else (i.e., another company).
A trademark protects a brand name or logo used on goods or services so that consumers know what kind of product they’re buying when purchasing from that company again in the future without having too much trouble finding out who actually owns them because there may be multiple owners with overlapping rights concerning their use within certain geographical boundaries such as country borders between countries where certain types of goods might legally fall under different legal jurisdictions due specifically those concerns I mentioned earlier when discussing international copyright laws related specifically toward protecting intellectual property ownership rights within borders instead within these countries’ own laws alone.”
What works are protected by copyright?
Copyright law protects all types of intellectual property, including literary works and musical compositions. The term “literary works” includes novels, short stories, plays and poetry. Musical compositions include songs and other musical works with lyrics (like pop songs). Dramatic works include dramas that were created before March 1, 1909 as well as movies made by companies who had been granted licenses by the Motion Picture Patents Company or its successor entity after that date; however this definition does not include any screenplays written specifically for films produced after 1909.
Music is also protected under copyright law but only if it’s accompanied by words (a song without lyrics can’t be copyrighted). This applies even if you don’t consider yourself a composer: if you sing along to an instrumental piece while driving your car or while walking down the street alone listening to headphones on Bluetooth technology then that would qualify as putting something into writing/recording which means it falls under our scope here today so stop asking questions!
Do I have to register with your office to be protected?
Do I have to register with your office to be protected? No. You do not need to register with us to be protected. You can register a work at any time, and we will review it as soon as possible after receiving your registration request. To learn more about how to submit an application for registration, visit our website: https://www.copyright.gov/register/contactus/.
How do I protect my work if it was created before 1978?
If you have created your work after 1978, and it’s not protected by copyright law, there are still ways to protect your work. You can register with the U.S. Copyright Office so that other people know who owns the copyright on your work and can’t copy or use it without permission from you (see “How do I protect my work if it was created before 1978?” above).
You can also use the © symbol with each page of text in a book or article—and this is especially important for comics and graphic novels!
How do I protect my work if it was created in 1978 or after?
You can protect your work by registering it with the Copyright Office. The Copyright Office is located in Washington, DC and they offer a free online form that you can fill out to register your work.
You need to register before infringement occurs so there’s no need to worry about filing a lawsuit after someone steals your work. If you have registered your work within five years of publication, then you will be protected for the life of both yourself and those who worked on it during that time period (until 70 years after death).
If I see something that I know is copyrighted material being given away on the Internet, should I accept it?
It is illegal to distribute copyrighted material without permission. If you see something that you know is copyrighted material being given away on the Internet, should I accept it?
The answer is no! It’s not just illegal, it’s against your best interests as well. You could be held liable for copyright infringement and sued for damages if someone files a lawsuit against you (which happens all too often) or be ordered by a court to pay their legal fees should they win their case against you. In addition to those penalties, there are other ways in which distributing unauthorized copies of copyrighted works could negatively impact your career and personal life:
-
Destroying the copy may cause damage or destruction beyond belief — literally destroying evidence that might help prove your innocence if someone does sue over this issue later on down the road;
-
Losing work product from being removed from circulation can mean losing customers who rely upon access over time periods like days or weeks instead of just minutes;
Takeaway:
The takeaway is that copyright laws are important for the arts and for society. They protect our creative works, which in turn helps to keep them alive and thriving. Copyright protects both economic benefits and public good, by ensuring that artists have an incentive to create new works in order to earn royalties from them.
Copyright law also has an important role in advancing science and technology through its encouragement of research into new forms of expression (such as music).
Conclusion
Copyright law is an important part of the legal system and it protects the works of authors. In order to be protected under copyright law, a work must be original and fixed in a tangible medium of expression. It also must be novel, creative or interesting enough to merit protection under copyright law.
